The Whitbread Case

In the 1992 court case that became known as the Whitbread case, a crofter in Wester Ross argued that the Whitbread Estate was not entitled to half the selling price if he bought all or part of his Croft and then sold it to a third party. The Land Court and the Court of Session ruled in favour of the crofter. This ruling was beneficial to the crofters' campaign as it came just days before the crofters' first press release in which the possibility of the crofters buying most of the estate at a fairly low price under the 1976 Crofting Act was raised. The threat to use this legislation along with the consequences of the Whitbread ruling made the purchase of the estate much less appealing to other potential buyers which meant less competition for the crofters.
